Any RN or LVN who is guilty of violating state laws and issuances from the Texas Board of Nursing (BON) may be subjected to penalties or fines. As a matter of fact, the RN or LVN license can even be suspended or revoked. To avoid this, it is important to look for the right nurse attorney.

The Texas Board of Nursing (BON) is the government agency that has jurisdiction to hear and decide administrative cases involving RN license and LVN license.  The BON has the power to suspend and/or revoke the nurse license.  It is also the agency that is responsible for overseeing the practice of professional nursing all over the State of Texas.

A perfect example of this happened to a LVN. At the time of the initial incident, the LVN was employed in a hospital in Dallas, Texas, and had been in that position for just two months.

On or about November  28, 2015, the LVN  did  not  take  reasonable   steps  to  ensure  a  Clinical  Institute  Withdrawal Assessment (CIWA) for a patient was completed every four hours or PRN, as ordered, and did not take reasonable  steps to ensure that Staff was completing  and documenting safety checks every 30 minutes.

It was the responsibility of the staff technician to complete and document safety checks every thirty) minutes, as this had been delegated to the staff technician.

Because of this, the LVN and the staff technician were summoned by the Texas Board of Nursing. During the hearing, the staff technician informed and reported to the LVN that he had completed and documented safety checks as required with no noted unusual findings regarding the patient during the entirety of this shift.

Further, the LVN provides that she checked in routinely, regularly, and personally with the tech during this shift and the tech never reported to her anything out of the ordinary or unusual with respect to any patients’ condition or status, other than the fact that the subject patient appeared to be sleeping.

The LVN was given the chance to defend her license but she failed due to lack of proper defense from a nurse attorney. Unfortunately, her LVN license was disciplined.

WHAT OUR CLIENTS SAY

I consider Yong as the biggest blessing in my life for this year. While I was practicing as a professional nurse in Texas, I received an order from the BON limiting my practice. This was problematic for me since I wanted to continue working for my employer. Yong was the one who wrote a reply letter to the Board and explained my innocence. He made all the necessary arrangements, which led to the issuance of an order in my favor…

I searched for a Texas lawyer who is good at handling nursing defense cases. During my research, I came across the website of Mr. Yong. I read positive comments from his previous clients, which made me become more interested in what he does. Because of this, I tried to send a message via the website. What made me really happy was the fact that a member of his team responded right away! He was so nice to me. I wish there won’t come a time that I would require the services of a lawyer. But right now, I have to say that I will recommend his firm to those who are in need!

The nice thing about Mr. Yong is that he is an expert in the legal aspect of the nursing industry. He has this ability in helping clients to feel calm and more relaxed while the case is going on. With his efforts, he was able to dismiss the case filed against me. I was able to keep my nursing license because of him. My case was quite difficult but he won! This only shows that he is an amazing and skilled lawyer in Texas.
