The Texas Board of Nursing (BON) is the government agency that has jurisdiction to hear and decide administrative cases involving RN and LVN in Texas. It is also the agency that is responsible for overseeing the practice of professional nursing all over the state of Texas. Any RN or LVN who is guilty of violating state laws and issuances from the Texas Board of Nursing (BON) may be subjected to penalties or fines if not properly defended by a Houston BON Attorney. As a matter of fact, the RN license and LVN license can even be suspended or revoked.

A perfect example of this incident happened in August 2006 to an LVN from Houston, Texas.

On or about August 26, 2006, the LVN lacked fitness to practice vocational nursing in that she exhibited impaired behavior while on duty including stumbling, difficulty with balance and slurred speech.

Her conduct could have affected her ability to recognize subtle signs, symptoms and changes in the patient’s condition and could have affected her ability to make rational accurate and appropriate assessments, judgments and decisions regarding patient care, thereby placing the patient in potential danger.

On or about September 24, 2006, the LVN allegedly engaged in the intemperate and unlawful use of Cocaine in that she produced a specimen for a drug and alcohol screen which resulted positive for Cocaine and she admitted to using Cocaine. Possession of Cocaine is prohibited by Chapter 481 of the Texas Health & Safety Code (Controlled Substance Act).

The use of cocaine by an LVN while subject to duty could impair the nurse ability to recognize subtle signs, symptoms and changes in the patient’s condition and could impair the nurse ability to make rational accurate and appropriate assessments, judgments and decisions regarding patient care thereby placing the patient in potential danger.

This is just one of the many cases why every nurse in Texas is expected to act with prudence in practicing the profession. Any form of gross negligence, disobedience or any form of offense on the part of a RN or LVN is never excused.

Any type of accusations can be defended, as long as there is a skilled Houston BON Attorney ready to assist you during the hearing before the Board of Nursing. The Texas Board of Nursing has full jurisdiction regarding cases that may affect an RN or LVN’s license from suspension, disciplinary action or revocation.

The LVN lost the case simply because she failed to find an effective and efficient Houston BON Attorney. Avoid committing the same mistake she did. WHAT OUR CLIENTS SAY

I consider Yong as the biggest blessing in my life for this year. While I was practicing as a professional nurse in Texas, I received an order from the BON limiting my practice. This was problematic for me since I wanted to continue working for my employer. Yong was the one who wrote a reply letter to the Board and explained my innocence. He made all the necessary arrangements, which led to the issuance of an order in my favor…

I searched for a Texas lawyer who is good at handling nursing defense cases. During my research, I came across the website of Mr. Yong. I read positive comments from his previous clients, which made me become more interested in what he does. Because of this, I tried to send a message via the website. What made me really happy was the fact that a member of his team responded right away! He was so nice to me. I wish there won’t come a time that I would require the services of a lawyer. But right now, I have to say that I will recommend his firm to those who are in need!

The nice thing about Mr. Yong is that he is an expert in the legal aspect of the nursing industry. He has this ability in helping clients to feel calm and more relaxed while the case is going on. With his efforts, he was able to dismiss the case filed against me. I was able to keep my nursing license because of him. My case was quite difficult but he won! This only shows that he is an amazing and skilled lawyer in Texas.
