An experienced nurse attorney has surely helped a lot of RNs and LVNs when it comes to cases that may lead to disciplinary action. Unfortunately, not all nurses were able to hire a nurse attorney as they underwent such cases. This incident that an RN committed on December 13, 2016, was one of those examples.
On or about December 13, 2016, the RN authorized the refill of amiodarone for a patient, with six (6) months of additional refills, without consulting with the provider. Her conduct was likely to injure the patient due to non-efficacious treatment and/or adverse side effects, as the result of continuing medication without physician consultation
Because of this, a complaint was filed against the RN.
In response to the incident, the RN reported she was aware of the mistake she made on December 13, 2016, she was counseled on this incident, and she was told by her supervisor that she refilled the prescription outside of the time frame of lab work that needed to be done. She reports after the re-teaching of all nursing staff, she was much more cautious with the refills of amiodarone.
The Texas Board of Nursing has full jurisdiction over all cases regarding errors committed by an RN or LVN. Thus, she was called by the Board to defend against the case.
The following incident and defense against the case caused the Texas Board of Nursing to place the RN and her license into disciplinary proceedings. She would have sought assistance from a good nurse attorney to provide clarifications towards the case.
