Subsequently, the LVN failed to take precautions to secure two (2) tabs of Divalproex 125mg, two (2) tabs of Levetiracetam 750mg, one (1) tab of Montelukast sodium 10ing, one (1) tab of Levothyroxine 50mcg, and one (1) single dose packet of Fiber-Star belonging to the facilily and patients thereof, in that the medications and Fiber-Stal were found in her purse. Respondent’s conduct was likely to defraud the facility and patients thereof of the cost of the medications.
The Texas Board of Nursing is the one who has full jurisdiction on cases involving RNs and LVNs. Therefore, the LVN was summoned by the Texas Board of Nursing to explain her side.
During the hearing, the LVN states she may have dropped medications into her briefcase, not her purse, by accident, but denies purposefully putting the medications in there. She states the briefcase was sitting open in one of the medication rooms. The LVN further states she was assigned to units on opposite ends of the building and was trying to complete the medication passes, so she was moving quickly.
