Accusations, complaints, allegations towards an RN or an LVN are reviewed and evaluated by the Board, if they need to be disciplined or not. But if you are an RN and violated the nursing laws, you should seek proper help from a nurse attorney. At the time of the initial incident, she was employed as an RN at a hospital in Carrollton, Texas, and had been in that position for five (5) months.

On or about July 9, 2020, while employed as an RN at a hospital in Carrollton, Texas, RN was accused of the following:

1. RN administered the wrong dose of medication to two (2) different patients, in that RN administered an estimated dose from a Vyvanse 50 mg capsule, instead of Vyvanse 30 mg, as ordered by the physician. RN signed out Vyvanse 50 mg on the Controlled Substance Administration Record, reported that she opened the capsule and poured out some of the powder granules to obtain the 30 mg dose, and wasted the remaining powder granules in the sharps container without a witness and without documentation on the Controlled Substance Administration Record.

2. RN administered the wrong dose of medication to another patient, in that RN administered an estimated dose from a Focalin XR 15 mg capsule, instead of Focalin XR 10 mg, as ordered by the physician. RN signed out Focalin XR 15 mg on the Controlled Substance Administration Record, reported that she opened the capsule and poured out some of the powder granules to obtain the 10 mg dose, and wasted the remaining powder granules in the sharps container without a witness and without documentation on the Controlled Substance Administration Record.

RN’s conduct above was likely to injure the patients in that the administration of the medication in excess and/or estimated dosage of the physician’s order could result in the patients suffering from adverse reactions. Additionally, RN’s conduct placed the hospital in violation of Chapter 481 of the Texas Health and Safety Code (Controlled Substances Act).

The above actions constitute grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(C),(1)(D)&(3)(A) and 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B),(1)(C),(4),(10)(C),(10)(D)&(11)(B).

The evidence against the RN was strong. At the same time, she was not able to properly defend her case in court. As a result, her nursing license was placed under disciplinary action by the Texas BON.
