On or about February 15, 2020, while employed as a Registered Nurse, the RN accessed the medical record of the Patient. approximately five (5) times without authorization. The RN’s conduct exposed the patient unnecessarily to risk of harm from use, accessing, or disclosure of their confidential medical information without their written authorization and placed the facility in violation of HIPAA (The Health Insurance Portability and Accountability Act).

In response, the RN states she has never accessed the medical records of the Patient. without authorization. The RN states she only accessed the record at the request of the Patient’s emergency contact to determine if she had contact with the patient or if she was part of the plan of care.
