It’s best to seek the help of a nurse attorney when facing different complaints and allegations. However, some nurses tend to face these results instead without thinking that nurse attorneys are always reliable for matters such as these.

On or about December 11, 2018, an RN was issued an Agreed Order through an Order of the Board.

On or about August 20, 2021, the RN was noncompliant with the Agreed Order issued to her by the Texas Board of Nursing on December 11, 2018. Noncompliance is the result of the RN’s failure to abstain from the consumption of controlled substances, in that she produced a urine specimen for a random drug screen that resulted positive for Tramadol. The RN failed to comply with Section V, Stipulation A of the Agreed Order dated December 11, 2018, which states, in pertinent part:

“While under the terms of this Order, PETITIONER SHALL abstain from the use of alcohol, nalbuphine, propofol, and all controlled substances, except as prescribed by a licensed practitioner for a legitimate purpose. If prescribed, PETITIONER SHALL CAUSE the licensed practitioner to submit a written report identifying the medication, dosage, and the date the medication was prescribed. The report shall be submitted directly to the office of the Board by the prescribing practitioner, within ten (10) days of the date of the prescription.”

In response to the incident, the RN denies ingesting Tramadol. However, denying the incident did not get her away from getting disciplinary action from the Texas Board of Nursing (BON).
