Any type of accusation or negligence can be defended, as long as there is a skilled nurse attorney ready to assist you during the hearing before the Board of Nursing. The Texas Board of Nursing has full jurisdiction regarding cases that may affect an RN or LVN’s license from suspension, disciplinary action or revocation.

At the time of the initial incident, an RN was employed as a registered nurse at a hospital in Balch Springs, Texas, and had been in that position for four (4) years and two (2) months.

On or about June 13, 2019, while employed, the RN inappropriately accessed the medical record of the patient, for reasons other than patient care and/or job-related functions.

In response, the RN states that on June 13, 2019, she was assigned to the Specialized Workforce Action Team (SWAT) role and was a member of the Clinical Resource Team (CRT- “float pool”). In that role, the RN would be sent to multiple areas and units of the hospital on the same day. The RN further states that it was her understanding that she was assigned to provide care for the patient, as soon as she left the area of the hospital in which she was at the time of that assignment. The RN further states access to the patient’s record was for patient care and/or job-related function.

The Texas Board of Nursing then subjected the RN and her license to disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney if the RN had hired one. Hiring a nurse attorney for defense is applicable for any kind of accusation laid against an RN or LVN.
