Any RN or LVN who is guilty of violating state laws and issuances from the Texas Board of Nursing (BON) may be subjected to penalties or fines. As a matter of fact, the RN or LVN license can even be suspended or revoked. To avoid this, it is important to look for the right nurse attorney.
At the time of the initial incident, an RN was employed as a Registered Nurse (RN) at a hospital in Austin, Texas, and had been in that position for eleven (11) months.
On or about January 29, 2020, while employed as a Registered Nurse, the RN exceeded her scope of practice by calling in an unauthorized prescription for Testosterone 200mg/ml 10mL to a pharmacy, for the patient, using the name and Drug Enforcement Agency (DEA) number. The RN’s conduct was deceptive and placed the facility in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.
On or about February 4, 2020, the RN exceeded her scope of practice by calling in an unauthorized prescription for Testosterone 200mg/ml 6mL for the patient, using the name and Drug Enforcement Agency (DEA) number assigned. The RN’s conduct was deceptive and placed the facility in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.
On or about March 10, 2020, the RN exceeded her scope of practice by transmitting an unauthorized electronic prescription for Cefdinir 300mg, for a Patient, under the name and Drug Enforcement Agency (DEA) number assigned. The patient returned to the clinic two days later with symptoms of an allergic reaction. The RN’s conduct was deceptive and may have contributed to the patient’s adverse reaction. Additionally, the RN’s conduct placed the facility in violation of Chapter 483 (Dangerous Drugs Act) of the Texas Health and Safety Code.
In response, regarding the patients, the RN states she had permission from the providers to call in the refills for testosterone. Regarding the patients, the RN states she sent an electronic prescription for Cefdinir to the pharmacy in error but claims she called the pharmacy to cancel the prescription.
Because of this, the RN was summoned by the Texas Board of Nursing (BON). The RN was given the chance to defend her license but she failed due to a lack of proper defense from a nurse attorney. Unfortunately, her license was disciplined.
