On or about September 27, 2016, while employed as RN in a medical facility in Lubbock, the RN failed to administer a flu vaccine and DTaP vaccine to a 15-month old patient as ordered by the physician. Instead, the RN incorrectly administered a flu vaccine and Hepatitis A vaccine to
On or about September 2016, through December 2016, while employed in the same medical facility in Lubbock, the RN failed to timely and adequately communicate with the physician and patients regarding home health orders, prescription authorizations, prescription refill requests, and durable medical equipment (DME) requests.
The RN was summoned before the Board to defend against the case. As a defense to the accusations filed against her, the RN admits she administered the Hep A vaccine but states she informed the physician verbally that she ordered the wrong vaccine. She states that her charge nurse told her she was supposed to make sure the physician was requesting the correct vaccination and that if the vaccine· was incorrect, she was supposed to correct it.
The RN further states this particular patient already had the correct amount of DtaP and needed a Hep A vaccine and flu vaccine as well. She explains that she was only following the direction of her charge nurse.
Regarding the orders, refills, and DME requests, the RN states that every fax they received with a refill request was placed directly on the physician’s desk. She states she faxed back all prescription refills, prior authorizations, home health orders, and DME requests. She states she also called to get prior authorizations when one was needed. The RN further states she called the patients’ family if the patient needed to be seen in order to get a refill and scheduled them for appointments.
The Texas Board of Nursing then subjected the LVN and her license into disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one. Hiring a nurse attorney for defense is applicable for any kind of accusation laid against an RN or LVN.
